EPA’s TSCA Inventory Notification Rule: Requirements & Impacts for Industry

The Toxic Substances Control Act (TSCA ), as amended by the Frank R. Lautenberg Chemical Safety for the 21st Century Act in 2016, which requires EPA to designate chemical substances on the TSCA Chemical Substance Inventory as either “active” or “inactive” in U.S. commerce. To accomplish that, EPA is requiring companies to report to the agency any chemicals they manufactured, imported or processed in the U.S. over the past 10 years. This reporting will be used to identify which chemical substances on the TSCA Inventory are active in U.S. commerce and will help EPA prioritize chemicals for risk evaluation as required by the amended TSCA.
Steve Owens is an attorney with Squire Patton Boggs and is the former EPA Assistant Administrator in charge of the agency’s Office of Chemical Safety & Pollution Prevention, which implements the TSCA program. Steve also was Director of the Arizona Department of Environmental Quality in Governor Napolitano’s administration and is the longest serving Director in ADEQ’s history. He has worked extensively with TSCA for many years and will present on the origin of this Inventory reporting rule and will provide insight and guidance to assist industry in complying with its requirements, as well as its potential impacts.
